Despite the implementation of the Human Rights Act (1998), older people still face treatment which runs contrary to these most basic rights.

The treatment of older people in care settings is a particular concern in this regard. We are therefore working hard to close the legal loophole which means that those older people receiving care outside local authority care homes are not protected by the Human Rights Act.

In this section you will find information relating to the implementation of the Human Rights Act and older people, and the work we are doing to make human rights a reality for every older person.

Memorandum on older people and human rights (January 2003)

Report exploring the difference a Human Rights Commission could make to older citizens by improving the quality of health care services and medical care in care homes, increasing personal expenditure allowances, protecting their right not to be separated from family, and introducing formal statutory guidance on the closure of homes.
